Welcome to VoyaStay! These Terms of Service govern your use of our platform. By using VoyaStay, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using the VoyaStay platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform.

2. Definitions

• Guest: A user who books a property through VoyaStay.
• Host: A user who lists a property on VoyaStay.
• VoyaStay: The platform connecting hosts and guests.
• Listing: A property listed for rent on VoyaStay.
• Booking: A confirmed reservation for a Listing.

3. Account Registration

• You must be at least 18 years old to create an account.
• You agree to provide accurate and complete information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are liable for all activities that occur under your account.

4. Guest Terms

4.1 Booking

• When you book a property, you enter into a direct contract with the Host.
• You must provide accurate guest count and payment information.
• You agree to follow the Host's house rules.

4.2 Payments

• Payments are processed via Stripe in a secure escrow system.
• Funds are held by VoyaStay until 24 hours after check-in.
• You authorize VoyaStay to charge your payment method for the total booking amount.

4.3 Cancellations

• Free cancellation up to 24 hours before check-in (subject to Host's policy).
• Cancellations made within 24 hours may be subject to fees.
• If you cancel, our service fee may not be refundable.

5. Host Terms

5.1 Listing Properties

• You must own or have legal authority to list the property.
• You must accurately describe the property, amenities, and rules.
• You must comply with all local laws and regulations.

5.2 Payouts

• Payouts are released to your Stripe Connect account 24 hours after check-in.
• Early payout requests may incur a small fee.
• You are responsible for any taxes owed on your earnings.

5.3 Guest Communication

• You must respond to guest inquiries promptly (within 24 hours).
• You must honor confirmed bookings unless there are extenuating circumstances.

6. Prohibited Activities

You agree not to:

• List properties you do not own or have permission to rent.
• Provide false or misleading information.
• Disrupt or harm the platform's functionality.
• Discriminate against guests based on race, gender, religion, or any protected status.
• Use the platform for illegal activities.

7. Fees and Payments

• VoyaStay charges a service fee to guests (percentage of booking total).
• Hosts receive the booking amount minus the service fee.
• All prices are in USD unless otherwise stated.
• Fees are non-refundable except as provided in our refund policy.

8. Liability and Indemnification

• VoyaStay acts as a marketplace only. We are not a party to the contract between hosts and guests.
• We provide the platform "as is" without warranties of any kind.
• You agree to indemnify VoyaStay against any claims arising from your use of the platform.
• Our liability is limited to the total amount paid by you through our platform.

9. Dispute Resolution

• We encourage you to resolve disputes directly with the other party.
• If a dispute arises, you agree to first attempt to resolve it informally.
• If unresolved, disputes will be resolved through binding arbitration in Los Angeles, California.

10. Termination

VoyaStay reserves the right to suspend or terminate your account at any time for any reason, including breach of these Terms of Service. You may also terminate your account at any time by contacting support.

11. Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law principles.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the platform.
